Our origins lay in the formation of Walker Persson and Partners Limited in 1968, with the subsequent merger with Spargo and Company in January 2000.

WPS are appointed Brokers to the AIS (Associated Independent Stores) Retailers Insurance Scheme. We act for over a quarter of the Membership across the UK, Scotland and Northern Ireland, making us the largest Intermediary for AIS. The Scheme, Underwritten by Royal & Sun Alliance, is recognised on a national level within RSA as one of the best performing Retail Schemes.

 

The AIS Insurance Scheme has been designed to supplement for many of its members the long and loyal relationship the member has with their incumbent broker, allowing the existing Broker to deal with us on a “Wholesale” basis. This has proven to be a very unique benefit of our offering.

WPS Town Council Insurance Scheme

 

We are pleased to provide our first quarterly e-bulletin.

 

January 2010

 

 

As mentioned in our last email, the topic of this is Liability Best Practice, which in view of the recent weather conditions has been extended to include some clarification of your responsibilities in regard to preventing slips and trips on icy pathways/pavements etc.

 

 

LIABILITY  BEST PRACTICE

 

Hiring of Halls: Slips and Trips

 

Carry out a risk assessment to prevent slips and trips. 

 

The risk assessment will require you to:

 

a.      Look for slip and trips hazards. For example:

Ø        Is the floor surface in good condition?

Ø        Are floors likely to become wet and slippery?

Ø        Can floor conditions change quickly? e.g. because of build up of waste

Ø        Do people use unlit or poorly lit paths or yard areas?

Ø        Are tripping hazards such as trailing cables routed away from walkways or covered/protected in some way?

Ø        Are cleaning rotas organised to avoid busy times?

Ø        Are cleaning substances chosen to reduce risk of slippery surfaces

b.      Decide who might be harmed and how

c.      Are there suitable controls in place?  If not determine new/improved control and implement

d.      Record findings

e.      Review on a regular basis

 

 

Prior to and after each hire of the premises an inspection should be carried out of the hall. Any areas which should be rectified should be completed prior to the hall being used again. A register should be maintained of the inspections, which should include the time, date, person dealing and a note of any repairs etc which have been carried out.

 

Ensure that the hirer of the premises has adequate Public Liability cover, (our own scheme is extended to include private individuals who hire your premises, however other policies may not).

 

Ensure that the hirer is aware of their responsibilities whilst hiring the premises; a checklist could be provided to them.  (A formal contract would be advisable).

 

Hirers of the premises should be asked to report any incidents or injuries to you immediately, at the time of the event.

 

 

General Slips and Trips

The responsibility of a Town council will involve many areas where slips and trips could produce a claim, i.e. Cemeteries, Parks, Allotments, Parks, Sports Facilities, etc.

Adverse weather conditions and the implications for your Council

 

a) Your responsibility to the public

With regard the problems associated with seasonal snow and ice, the Health & Safety Executive will expect you to ensure the safety of visitors to those public areas that are within the Council’s control.  Councils should therefore grit and/or salt the areas concerned, in so far as resources enable you to do so.  Where resources are limited, their use should be dictated by priority and those areas with the heaviest foot or motor traffic should be treated first.  Where resources do not extend to allow you to treat all areas, those areas which remain untreated should either be signed as hazardous or roped off from public access.  Details of your activities should be recorded, detailing what was done and when it was done, so that you have a log of your reasonable precautions.

 

We appreciate that these are rather onerous steps to take, but we are wary that there will be claims made by individuals who slip and suffer injury, and believe that some will succeed if it cannot be demonstrated that reasonable precautions were taken.      

 

b) Provision of grit-bins only

If your Council is simply supplying the grit bin & the grit, then it is unlikely that any liability arising from an incident would be connected to your Council, unless the grit bin or the grit itself caused injury/damage to someone/something.

 

If local residents will simply be availing themselves of the grit for their own personal use (driveways etc) they would be acting on their own initiative and if their actions caused any damage/injury they would hopefully be protected by their home insurance.  Similarly, if they take it upon themselves (without direction from the Council) to spread grit on the public highways it will be the residents that any injured party should approach for compensation following an incident resulting from the grit spreading, which again should hopefully be covered under the resident’s home insurance.

Whether or not the residents have home insurance is beyond the Councils control.

 

It would be extremely unlikely that liability could attach itself to your Council unless your Council were to be involved in the actual use of the grit, (other than your liability in regard to the box itself causing injury/damage, e.g. having jagged edges that someone cuts themselves on; or the grit you are supplying turning out to be harmful in some way).

As unbelievable as it may seem at the moment given the current coldness, it will not be long before summer arrives and children are back in the great outdoors seeking entertainment.

 

With that in mind this factsheet offers some tips in regard to managing your responsibilities in connection with play areas.

 

 

Playground Equipment

 

Risk taking is certainly an element of play provision.

 

Play provision aims to offer children the opportunity to encounter acceptable risks as part of a stimulating, challenging and controlled learning environment.

 

Equipment designed to the current standards and which is properly maintained should generally provide the desired risk and challenge whilst ensuring freedom from unacceptable risk of life or permanently disabling injury.

 

The following steps are a guide towards preventing accidents in this area.

 

·         Establish a robust purchasing policy for new play equipment

 

·         Carry out and record a risk assessment or review any existing assessment of the playground equipment.

 

·         Give consideration to whether the equipment complies with the latest standards .What action is needed to make it comply.

 

·         Establish and record a regular inspection and maintenance regime for play areas.

 

·         Take into account the typical usage of the equipment, likely damage, and wear and tear from previous inspection and maintenance records

 

·         Make reference to accident records and reports including incidents with the potential for a more serious outcome.

 

·         Develop a prioritised action plan to address any deficiencies identified by assessments

 

 

Skateboard Parks

 

Skateboarding is an exciting sport and accidents will occasionally occur. 

 

This is a sport which requires careful management.

 

·         Erect signs stating that helmets and protective pads must be worn

 

·         As with playground equipment, carry out regular inspections and maintain a register.

 

·         Ensure users know where to report a fault

Thank you to all our Town Council clients for the continued support. You may be interested to learn that we have a 100% retention rate of our Council clients and this is something we intend to maintain.

 

We now act and advise in excess of 210 Town Councils throughout England & Wales. Our rapid growth will not compromise our personal and professional service provided by a team of individuals dedicated to the Town Council sector.  

 

 Due to a number of Councils concerns over this issue we are pleased to provide our next quarterly e-bulletin, which this time reflects upon issues relating to your motor vehicles, and hope this is of use:

 

The Requirement To Insure ALL Vehicles Used On Public 'Roads'

 

The variety of motor vehicles owned by Councils range from private cars  and commercial vans to agricultural vehicles such as tractors and motorised mowers.

 

Whilst Clerks are aware of the obligation to insure the obvious vehicles, e.g. cars, vans, tractors etc, some are less sure of the requirements to insure motorised items that are sometimes considered to be mere items of machinery, such as mowers.

 

As a rule the Road Traffic Act demands that any motorised vehicle used on a public road MUST be insured for Third Party risks.

 

The definition of a 'road' can be a grey area, but can include any area that the public have access to such as a car-park, a fore-court, or a grass verge.

 

As such, a motorised mower (even one that is transported by trailer) that is used on grass verges, playing fields or similar areas is likely to be deemed to be used on a public 'road', and therefore requires a minimum of Third Party Only insurance. 

 

  • Third Party Only cover starts from as little as £73.50
  • Comprehensive cover from as little as £94.50.

 

 

Of course it is not always the cost that is important, rather that the Council is  legally protected. If you are in any doubt about the adequacy of your insurance, please contact us to discuss your needs, we would be delighted to provide you with  technical advise on the subject. 

 

Motor Insurers' Database (MID)

 

The MID was set up primarily as a tool to aide the police in reducing the number of uninsured drivers on our road, (the costs associated with uninsured drivers exceeds £500 million each year).

 

Details of all road registered, insured vehicles (with few exceptions) must be submitted to the MID within defined periods. These strict timescales vary according to the type of insurance policy, but in regard to Councils we recommend that you advise your insurer or broker of ALL vehicle changes immediately so that they can update the database on your behalf, (there may be one or two of you that have undertaken the responsibility to update it yourself, in which case the same urgency applies).

 

Failure to update the MID can result in a fine of up to £5,000.

 

The MID is only concerned with road registered vehicles, so details of any un-registered vehicles will not need to be submitted.

 

 

Ministry of Justice Reforms - Personal Injury Claims

 

On the 30th April 2010 the Ministry of Justice introduced a new handling procedure for Personal Injury claims resulting from motor accidents.

 

The most significant aspect of these reforms from your perspective is that your insurers will only have 15 working days from the claim being notified (either by you or the other party involved) to make a decision regarding liability.

 

If your insurer is unable to comply within that timescale there will be financial penalties, which will ultimately affect your claims experience and therefore your premium.

 

So it is crucial that you notify your insurer immediately of any accident that you or your drivers are involved in rather than waiting to hear from the other party. Time is of the essence, and if claims are not notified quickly they will almost certainly end up costing you more.

 

Here are a few suggestions of how you can help your broker/insurer to help you:

  • Make your drivers aware of your broker's &/or insurer's claims line telephone numbers
  • Provide your drivers with an *accident report form to get the important information if they are involved in an accident
  • Allow your insurers direct access to your driver - when notifying a claim let your broker/insurer have your driver's telephone number
  • Equip your drivers with a camera or a mobile phone with a camera facility - a photo of the scene is a very useful addition to a description
  • Review your own procedures, for example:-
    • Implement & enforce a reporting procedure for drivers
    • Interview drivers quickly
    • Send on paperwork without delay (emailing copies if possible)
    • Allow your insurer to contact your driver directly
  • Be PRAGMATIC - if the accident is your fault confirm this to your broker/insurer straight away, as contested claims will certainly cost more.

 

 

*If you do not have an accident report form from your own insurer we have attached a template that you may wish to use, (you will need to insert your insurer's claims telephone number) - it would be good practice to have your drivers keep a copy of this in their vehicles.

Nationwide Riots August 2011

 

 

There can be no doubt that the levels of civil unrest/riots over the last few days in London and other parts of the UK have been unpredictable and regrettably serve as a costly reminder how these dreadful events cause havoc to property and business owners, their staff, customers and revenue.

 

In the last few days Police, F&RS and utility providers have been stretched to unprecedented levels and these situations can be a reminder why you need to take action to protect your property and business.

 

It's vitally important that Councils continuously exercise an extra high level of diligence in maintaining protective measures and review current fire, safety and security procedures. We firmly believe that despite the unpredictable nature of some of these events that sound risk management measures can be taken to reduce the likelihood of loss or damage to property and its consequences on your business.

 

We strongly recommend that all Councils in metropolitan cities and the London suburbs affected, as a first step, should immediately identify the threats they may face and wherever practical, introduce risk management measures to protect their employees, physical assets and ultimately their bottom line.

 

There are a number of safety considerations you should address including:

 

Violence to staff – you should where practicable:

o Avoid unaccompanied working

o Avoid visiting potential problem areas

o Make use of two-way radio links and personal alarms

 

Intruder alarms / CCTV– ensure that all security systems are functioning and set in their entirety whenever the premises are unattended

 

Physical security to buildings – ensure that:

o Existing perimeter barriers are in good repair

o Doors and door hardware are adequate and in good repair

o Accessible windows adequately secured and protected

o Keep removable grilles/shutters in position throughout all hours (even during opening hours)

o Consider temporary boarding up of vulnerable access points and windows particularly in high risk areas

 

Waste & combustible materials – all waste and other unwanted combustible materials are an obvious source of ignition and may be targeted and hence should be kept to a minimum

 

Fire fighting equipment – ensure adequate equipment is readily available to hand and staff trained in their use

 

Projectiles – wherever possible remove portable objects from the open that could be used as projectiles e.g. advertising boards, display stands etc

 

Security lighting – ensure that this is operating throughout all hours of darkness

 

High value contents & stock – options to consider include:

o Removal for safe storage elsewhere

o Place theft attractive stock within a physically robust area that would require greater time and effort to  

   penetrate than the shell of the building

o Remove attractive stock from display windows

o Consider delaying the delivery of attractive stock to your premises until current unrest has subsided

 

Vehicles in the open – to protect these you should:

o Remove and avoid parking vehicles overnight in high risk areas and on main thoroughfares

o Avoid parking vehicles in close proximity to buildings

 

Garage Forecourts – avoid storage /display of vehicles on forecourts in high risk areas in the short term, preferably to a secure compound wherever possible

 

Manned Guarding – consider introduction of security guards increasing the hours of guarding presence and/or increasing the number of guards present

Riot claims reporting time lines

 

Following the rioting across the UK we’d just like to reassure you that Aviva’s claims centres of excellence have teams of experts ready to manage any claims arising who are working closely with loss adjusters and suppliers to support our policyholders.

 

If you need any further assistance or clarification please speak to your usual WPS Account Handler.

 

With claims of this nature there are specific time lines to meet for insurers to be reimbursed by the local police authority.

 

The local police authority has a legal responsibility to reimburse anyone sustaining damage to property as

the result of a riot under the Riot Damages Act 1886. Any claim under the Act must ‘’be made in writing and received by the local police authority within 14 days of the alleged incident”.

 

Insurers typically include within their Claims Notification Clause to the policy a requirement for any

claim for riot and/or civil commotion to be notified to Insurers immediately with full supporting documentation. This needs to be received within seven days of the incident occurring specifically to prevent a recovery action being turned down by the police authority on basis that the action is time barred. Insurers are entitled to recover their outlays under the principle of subrogation.

 

Anyone claiming needs to be aware that they must notify Aviva immediately of any damage but equally important is that they must be able to quantify and substantiate their losses with potentially both a schedule of loss and statement of truth within a week of the incident occurring.

 

The Act excludes liability for loss or damage to cars left on public highways, goods left in shops for repair

and/or consequential losses. Also all claims will be assessed in accordance with common law, which may

not correlate directly to the basis of settlement provided for by the insurance contract.

INSPECTION OF TREES

 

 

If you’ll pardon the pun this old chestnut has raised its head again. As you will see in the attached article two recent tragic cases have highlighted the potential exposure that you face in managing your tree stock.

 

As owners of land with trees on, you do have a responsibility to try to make them as safe as possible, you need to have in place an inspection and maintenance scheme that is thorough and documented.

This should answer most basic questions regarding this subject, in essence you are expected to have reports on the trees made by a qualified person (annually, or more frequently if they are in an area which has a higher footfall or following a storm), it is also recommended that additional ‘walk-by’ inspections are carried out in between.

 

With regard to inspecting the trees:  Aviva have no problem with you using a qualified member of your own staff to carry out the inspections, (as to what qualifications they need, you should take advise from an expert source such as the Royal Forestry Society or the Forestry Commission), but in addition to being qualified the person inspecting should have a suitable amount of experience & expertise (again, the experts in this field would be able to advise you on what that should entail).

 

There is also a useful document on the Forestry Commission’s website http://www.forestry.gov.uk/pdf/fcpg13.pdf/$FILE/fcpg13.pdf which offers detailed guidance on how to safely manage tree stock.

WPS Town Council Insurance Scheme DIAMOND JUBILEE AND OLYMPIC CELEBRATIONS

 

 

Many of you are planning to celebrate Her Majesty The Queen's Diamond Jubilee this year and/or The Olympics.

 

As you start to finalise your event plans you are no doubt considering the insurance implications. We therefore thought it prudent to give you some pointers now, which will hopefully assist your planning and ensure a safe trouble free event.

 

Please cross refer to the recently e-mailed Town Council Risk Management guide from Aviva which has an excellent detailed section on organising events in general. Also, if you are having a beacon built, please don’t forget to register it with the official Queen’s Diamond Jubilee Beacon website.

 

The first thing to be considered is who is actually organising the event? Is it going to fall 100% under the Town Councils control, or is a separate group being set up to organise and run the event independently of the councils control? This will determine whether your existing policy will cover the risk, possibly subject to an additional premium, or whether a separate short period event policy is required.

 

Then the key information we will need to know to ensure your event is adequately covered is:-

 

  • Name and date of event

 

  • Type of event and venue

 

  • Expected attendance numbers

 

  • Principal activities

 

  • Are there any “dangerous” or “high risk” activities ?

 

  • Is there any additional equipment that needs cover ?

 

  • Any road closures ?

 

  • If necessary has the permission of the local authority been sought & granted ?

 

  • If necessary has the advice of the police or fire authority been sought ?

 

  • Any other material/pertinent facts

 

If you are lighting beacons/bonfires or having firework displays, then specific cover conditions will apply and we can advise you of them if appropriate.

 

Finally, we are aware of at least one council who are undertaking a Diamond Jubilee road trip visiting their twin towns in Europe. If you are considering this please ensure your motor insurer is advised as your policy may need extending.

Health and Safety at WPS

The effective management of safety has always been important from both a legal and moral perspective.

 

WPS has for many years, provided clients with a high quality independent insurance broking service. Our experience shows that many companies with whom we work do not have the resources or expertise to meet the demands of current Health & Safety legislation.

 

These demands are increasing and will continue to do so. There is now a much greater emphasis on the management of Health & Safety within any business organisation and there is a requirement to demonstrate compliance by adequate documentation and to provide evidence of this. It is no longer sufficient to take a purely commonsense approach to Health & Safety in the workplace. The Health & Safety Executive's targets announced by the Government promise greater enforcement of the standards and penalties for those who fail to meet these standards.

Business Continuity

Business Continuity Management is the concept of thinking ahead to consider what threats are faced by the organisation, whether and how these can be reduced or eliminated and the steps to be taken in an emergency situation.

Carefully arranged insurance is part of this planning process but insurance can never provide the complete answer.

Some losses are clear and purely financial but others may be hidden or less obvious, such as the result of adverse publicity, the knock on effects on dependant business, the waste of unproductive time etc.

Continuity Management must, therefore, embrace the insurable and uninsurable threats to the business.

The benefits of planning ahead are to identify, evaluate and reduce the threats and to plan the course of action to take if and when they arise.  In addition there will have been achieved improved risk management, a reduction in the risk, better resource management and staff awareness together with a planned and coordinated state of preparedness.

We can work with you to:

  •   Identify the risks (whether manmade or natural) to which you are exposed 
  •   Assess the effects of these risks on the businesses

WPS Insurance Brokers & Risk Services are delighted to have won the coveted Insurance Times Independent Regional Broker of the Year Award for 2006. Richard Persson of WPS receives the coveted award from David Parker of NIG group.

This success seals a fantastic year for WPS and is very much dedicated to our team of insurance professionals back in Plymouth.

Formed in 1968, we have for many years been recognised as one of the South West’s leading insurance brokers.  Earlier in 2006 we completed a management buy out realising the succession issues that many businesses have but creating ownership and continued independence in-house.  The buy out enhanced our position in our market place and has further enabled us to develop our reputation of tailored insurance and exposure based risk solutions complemented with bespoke claims management, health and safety and risk management services.
